An Overview of the Latest Lawsuit against Rosemead High
The most recent lawsuit against the El Monte Union High School District called the school a “predators’ playground,” where staff members were allowed to prey on female students for the purpose of sexual gratification. Filed on July 24, 2024, the lawsuit includes accusations against numerous teachers, sports coaches, and other district employees for incidents that took place between 1992 and 2003. The accusations mirror the ones included in a previous lawsuit that was filed against the school district by 3 former students, who claim that they were abused between the years of 2005 and 2011.
Both lawsuits cite negligence by school administrators for ignoring their cries for help, or claiming that the incidents were investigated, but there was no evidence of sexual misconduct. Overall, little to nothing was done for more than 4 decades, while educators openly hit on students, made sexual remarks, and groomed them into sexual relationships.
In a particularly tragic account, one victim said she went to someone she considered a mentor because she was being targeted by several employees at the school. Instead of calling the police or finding some other way to help the girl with the relentless harassment, he used it as opportunity to rape her.
In short, the plaintiffs are holding the district liable for allowing the toxic culture of child sexual abuse at the school for so many years.
Can I Sue the School District if I was Sexually Abused at Rosemead High?
Yes, you can file a lawsuit for sexual abuse against the El Monte Union High School District for not taking appropriate action to protect you from a sexual predator. Even if you did not come to them with allegations, it’s hard to believe that the school was completely unaware of inappropriate conduct taking place between students and workers at the school. In short, Rosemead High administrators and district officials were clearly negligent in their duty of care to the students they serve.
Even more tragic is how many of these women blamed themselves for what happened. Some of them had no clue that they were victims with the right to go to the police or demand justice through a civil lawsuit. In the last few years, Business Insider reporter Matt Drange wrote a series of articles detailing allegations against 20 different educators who engaged in sexual relationships with students at the school. None of these teachers were removed from the school; in fact, some of them are still working for the El Monte Union High School District.
Maybe you have been keeping tabs on this story after reading Matt Drange’s articles. But even if this is the first time you are hearing about lawsuits filed by alumni of Rosemead High School, please know that you did nothing wrong, that you are a victim, plain and simple. Even more important, you have the right to hold your abuser and the school district responsible. Please know that our attorneys are here to listen to your story and guide you through the legal process from start to finish.
What is the Amount I can Receive if I Sue Rosemead High School?
A sexual abuse claim against a school district may result in payments between $400,000 and $5,000,000. This is solely an estimate range, so you will certainly find lawsuits with lower or higher settlements. However, it’s safe to say that the sexual abuse of students by teachers and other school employees is worth 6 to 7 figures, and sometime 8 figures ($10,000,000 and above) for the most extreme cases. You may come across higher verdicts and settlements – perhaps in the range of $20,000,000 to $50,000,000, but these are generally associated with class action lawsuits, which are filed by multiple victims. How Long Do I have to File a Lawsuit?
In general, victims of sex abuse during childhood have 22 years from their 18th birthday to file a lawsuit. In other words, the day you turn 40 is the cutoff point for a lawsuit against the El Monte Union High School District. But let’s say you are over 40 years old and just starting to come to terms with what you experienced. Is it too late to sue the school system for negligence that contributed to the sexual abuse of minors?
No matter how old you are, you may still qualify for a lawsuit under the terms of California’s discovery rule. This is a legal exception for those who have a delayed realization of the physical and/or emotional harm they suffered from sex abuse during childhood. For the most part, these cases involve mental health conditions resulting from the trauma of sexual assault and exploitation. Once the victim realizes the connection between the abuse and their current suffering, they have 5 years to file a claim for compensation, regardless of their age.
